Welcome to The Tribalist! These Terms and Conditions govern your use of our services, including AI-powered home health assessments, subject-specific consultations, and full transformation services. By engaging with our services, you agree to comply with these terms.

2. Scope of Services

The Tribalist offers:

• Short, Subject-Specific Consultations – One-time expert guidance on specific home health topics.
• Makeover Plans – AI-based assessments coupled with product recommendations.
• Personalized Coaching Sessions – AI-powered makeover plans reviewed with a live Tribalist Consultant.
• Transformation Plans – In-depth services involving multiple sessions with a professional Tribalist Designer.
• HealthyHomeAI & AI-Powered Services – Includes AI-driven home coaching, research insights, and automation tools.
• HealthyHomeAI Helper – AI-driven home management, inventory tracking, and waste reduction solutions.
• AI-Powered Product Assessments – Real-time product evaluation via The Tribalist app.
• Post-Purchase Support – Follow-ups, scheduling, and recommendations based on our automated process flow.

Each service is designed to assist with healthier home practices, but The Tribalist does not provide medical, legal, or regulatory advice.

3. Customer Responsibilities

To ensure the best results, customers agree to:

• Provide accurate information about their home environment, including photos and relevant details for assessment.
• Follow AI and consultant recommendations at their discretion.
• Use AI-powered assessments responsibly, recognizing that results are based on available research and data analysis.
• Respect the consultation duration and scope, as detailed in the service description.
• Clients may request that The Tribalist delete or destroy their submitted photos and information after services are rendered by contacting customer support.

4. Payment and Pricing

• All pricing is listed on The Tribalist website and is subject to change.
• Full payment is required at the time of booking.
• Subscription-based services (if applicable) will automatically renew unless canceled.

5. Service Delivery Timeline, Cancellations, and Refunds

• No refunds will be provided once services have commenced, including AI analysis, coaching, and transformation sessions.
• No refunds for AI-powered Makeover Plans once the assessment has been generated.
• No-shows for consultations or coaching sessions will not be eligible for refunds or rescheduling.
• Clients may reschedule consultations with at least 24 hours' notice, subject to availability.
• All services must be delivered within 120 days of purchase, assuming reasonable efforts are made to accommodate the client's schedule and availability. If a client is unresponsive or repeatedly reschedules beyond this timeframe, The Tribalist reserves the right to mark the service as complete without refund.

6. AI Services & Data Use

• AI-powered assessments provide recommendations based on available research and analysis.
• AI-driven services such as HealthyHomeAI and HealthyHomeAI Helper will utilize automated insights to enhance home management.
• The Tribalist may collect anonymized data to improve its AI services and product recommendations.
• Customers can opt out of data collection in accordance with our Privacy Policy.

7. Limitations of Liability

• The Tribalist is not responsible for individual results related to home improvements, product recommendations, or behavioral changes.
• AI-generated recommendations are based on available data and research but should not be considered professional medical, legal, or environmental advice.
• The Tribalist is not liable for any damage, injury, or loss resulting from the implementation of recommendations.

8. Intellectual Property

• All materials, including guides, assessments, and recommendations, are the intellectual property of The Tribalist.
• Guides are short booklets created by The Tribalist and may not be reproduced or distributed without permission.
• Customers may not reproduce, distribute, or resell The Tribalist’s proprietary content without written permission.

9. Ownership of Submitted Information, Privacy, and Confidentiality

• The Tribalist respects customer privacy and does not share personal information with third parties without consent.
• The Tribalist retains ownership of any submitted photos and information provided for assessments, consultations, or transformation services. However, clients may request deletion of submitted photos and information after services are rendered by contacting customer support.
• Data collected is used solely for service improvement and customization.

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of California, where The Tribalist is headquartered. Any disputes arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration in Santa Clara County, California in accordance with the rules of the American Arbitration Association. By agreeing to these Terms, you waive your right to bring a lawsuit in court, except for matters that qualify for small claims court.

11. ADA Compliance and Accessibility

• The Tribalist is actively working on ensuring that all AI-powered services, assessments, and consultations are accessible to individuals with disabilities in compliance with the Americans with Disabilities Act (ADA) and other relevant accessibility standards.
• If a client requires accommodations or assistance due to accessibility needs, they may contact customer support for further guidance and support.
