1. Introduction

These Terms and Conditions ("Terms") govern the provision of virtual sustainability consultation and design services ("Services") offered by The Tribalist ("Company"). By purchasing and using our Services, you ("Client") agree to abide by these Terms.

2. Services Overview

The Company offers virtual sustainability consultation and design services similar to interior design and personal home organization. These Services are provided virtually and are sold by room, each comprising several subspaces.

3. Scope of Work

• Rooms and Subspaces: Each room (e.g., kitchen, bathroom, bedroom) has multiple subspaces (e.g., pantry, refrigerator/freezer, under sink for a kitchen).
• Intake Assessment: Clients complete an online intake assessment form for each subspace.
• Consultations:
• Initial 60-minute virtual consultation after reviewing the intake assessment.
• Follow-up tasks for the client to complete, including inventory and measurements.
• Second virtual consultation to present design options, shopping lists, and implementation plans.
• Completion Timeline: The entire room and all its subspaces must be completed within 120 days from the purchase of the consultation package.

4. Client Responsibilities

• Intake Forms: Clients must accurately complete and submit the intake assessment forms for each subspace.
• Task Completion: Clients are required to complete additional tasks, such as taking inventory and measurements, within the specified time.
• Consultation Attendance: Clients must attend scheduled virtual consultations punctually.
• Timely Communication: Clients must communicate any changes or issues promptly to avoid delays.

5. Company Responsibilities

• Review and Assessment: The Company will review intake assessment forms and prepare for consultations.
• Consultations: Provide virtual consultations as per the schedule agreed upon with the client.
• Design and Implementation Plans: Offer sustainable design options, shopping lists, and detailed implementation plans during the second consultation.

6. Payment and Fees

• Packages: Services are sold as packages per room.
• Payment Terms: Full payment must be made upon purchasing the consultation package.
• Refunds: Refunds are not provided once the initial consultation has taken place. If the client wishes to cancel before the first consultation, they may receive a partial refund at the Company's discretion.

7. Completion and Extensions

• 120-Day Completion: All work for a room and its subspaces must be completed within 120 days of purchasing the package.
• Extensions: If the Client cannot complete the process within 120 days, they may request an extension. Granting extensions is at the Company's discretion and may involve additional fees.

8. Confidentiality

• Client Information: The Company will maintain the confidentiality of all client information and materials provided.
• Designs and Plans: Clients agree not to disclose or share design options and implementation plans provided by the Company with third parties without prior consent.

9. Intellectual Property

• Ownership: All designs, plans, and materials provided by the Company remain the intellectual property of The Tribalist.
• Usage: Clients are granted a non-exclusive, non-transferable license to use the designs and plans for personal use only.

10. Limitation of Liability

• Accuracy of Information: The Company is not responsible for inaccuracies or errors in the client-provided information, such as measurements or inventories.
• Implementation: The Company is not liable for any damages or issues arising from the client's implementation of the design plans.

11. Termination

• Client Termination: Clients may terminate the service at any time, but no refunds will be provided once the initial consultation has occurred.
• Company Termination: The Company reserves the right to terminate services if the client breaches any terms, particularly regarding payment and timely completion of tasks.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state/country in which The Tribalist operates.

13. Amendments

The Company reserves the right to amend these Terms at any time. Clients will be notified of any significant changes.
